Despite her insistence last month, a DuPage County judge did not set a trial date on Wednesday for a man accused of a 2006 rape.
Larry Barrett, 23, of Summit broke into a 29-year-old Downers Grove woman’s apartment Oct. 9, 2006, and repeatedly raped her, authorities said. He later was arrested downstate in Mt. Vernon on an unrelated misdemeanor charge.
Barrett’s attorney, public defender Steve Dalton, has filed a motion seeking to bar the arrest from being used as evidence in the case. Circuit Judge Blanche Hill Fawell scheduled a Nov. 7 hearing on the motion.
When Barrett appeared in court last month, Fawell said she wanted to set a trial date because his is one of the oldest cases before her.
