Village braces for lawsuit or settlement

The attorney representing developer Karry L. Young and K2 Architects is hopeful a July 31 court ruling will entice the village of Broadview to begin discussing a monetary settlement with his client for services rendered regarding a proposed development on Roosevelt Road.

Meanwhile, the village’s attorney has until the end of the month to plan the next step in fighting the more than $700,000 lawsuit.

At the motion hearing, Cook County Circuit Court Judge Ellen Greenberg dismissed a charge of breach of contract by the plaintiffs since there appears to be no evidence the Broadview Village Board ever voted to officially hire Young for the project.

Greenberg did deny a motion to dismiss claims of promissory estoppel, meaning the village made promises to induce Young to keep working on the project even though no formal contract existed with the village, and also would not dismiss a charge of violating the state’s Freedom of Information Act.

Young claims the village owes him for services rendered between 2003 and 2005 in the planning of an $11 million  mixed residential/commercial project located on the north side of Roosevelt Road between 13th and 14th avenues.

His attorney, Berton N. Ring, said he was pleased with the judge’s decision.

“I believe the court made the correct ruling, and I am happy that it vindicated my client’s claims against the mayor (Henry Vicenik) and the village of Broadview,” Ring said. “The mayor and the village must answer those fraud-based claims.”

The village’s attorney, Michael Cainkar, said the next step is to finalize an answer to the remainder of the complaint, followed by preparation to take the case further in the courts.

Vicenik said the project is by no means dead.

“We’ve got another developer who is working on it right now,” he said, adding the new project is twice the size and cost of the project presented by Young, and includes 85 condominiums and 16,000 square feet of retail space at a cost of $22 million.

Ring said the ruling should encourage the village to begin discussing its responsibility to his clients.

“At this point, there has been no serious settlement discussion from the village of Broadview,” he said. “Perhaps this ruling by Judge Goldberg will force the (village) and the mayor to go into more serious discussion with our clients.”
