UPDATED: Prosecutors drop charge in fatal motorcycle crash

Kane County prosecutors last week asked a judge to dismiss a minor traffic charge against an Aurora woman believed to be responsible for a crash that killed a St. Charles couple on their motorcycle late last month.

State’s Attorney John Barsanti said his office is investigating possible charges of reckless homicide or aggravated driving under the influence in connection with the May 23 crash near Elburn.

Because his office was told it would take up to six months for the Illinois State Police crime lab to process toxicology tests for Alia N. Bernard, 19, of Aurora, the lesser charge was dropped to allow for potential prosecution on the more serious charges, Barsanti said.

While case law remains somewhat unclear, Barsanti said a guilty plea to a traffic charge connected to the crash could prevent prosecutors from pursuing additional felony charges.

“Rather than take that chance, the cautious thing to do, the conservative thing to do, is get that traffic offense out of the court system so you don’t have that possibility,” he said.

Lt. Luis Gutierrez, a spokesman for the Illinois State Police, said the six-month figure is inaccurate. Currently it takes about 72 days to process toxicology tests, he said.

The state police are working with the Kane County authorities to process the results in a timely manner, Gutierrez said.

Wade and Denise Thomas were killed the morning of May 23 when a car struck their motorcycle during a multiple-vehicle crash near Elburn.

Bernard originally was cited for failure to reduce speed to avoid an accident. Associate Judge Ronald Matekaitis granted a request by prosecutors to dismiss the charge.

Wade, 44, and Denise, 43, were riding to Wisconsin with a group at about 8:30 a.m. May 23 when the crash occurred, authorities said.
