Wife of Braidwood man killed in car crash sues driver, family members

JOLIET – The wife of a Braidwood man killed in a crash on Interstate 55 is suing the Missouri man who was charged in connection with the crash.

On Jan. 4, Sandra DeBoard, the widow of Michael D. DeBoard, 60, of Braidwood, filed a wrongful death lawsuit against Lucas M. Roth, 28, of O’Fallon, Missouri, as well as his family members Louis M. Roth and Michael A. Roth, both of Homer Glen.

“We’re just seeking justice for the family of a guy who was innocently driving on his way to work,” said Bryan Shell, Sandra DeBoard’s attorney.

The lawsuit seeks $50,000 in damages against each of the defendants.

Lucas Roth’s attorney, Ted Hammel, declined to comment through his law firm’s secretary when reached Wednesday afternoon. Hammel is representing Roth in a criminal case in connection with the crash.

Lucas Roth was arrested and charged with aggravated driving under the influence causing death and bodily harm in connection with a crash Aug. 9 in which Michael DeBoard was killed.

Roth was allegedly the driver of a Kia Optima that crashed into Michael DeBoard’s Ford Aspire on I-55 near Bluff Road in Channahon. Police alleged he had a blood-alcohol concentration of 0.08 or more while he was driving.

Michael DeBoard was taken to Presence Saint Joseph Medical Center, where he died from to his injuries.

Sandra DeBoard’s lawsuit alleges Lucas Roth failed to keep proper lookout for other cars, failed to see Michael DeBoard’s car, failed to maintain proper control of his car, failed to operate the car to avoid a collision, drove intoxicated and was otherwise careless and negligent.

The lawsuit also alleges Lucas Roth’s family members Lois and Michael gave him permission to use their Kia Optima while knowing he was not a safe and cautious driver.
