Riverside Board approves settlement with former fire chief

RIVERSIDE – The Riverside Board of Trustees approved a settlement of a lawsuit filed by former Village Fire Chief Kevin Mulligan at its regular meeting Thursday.

The lawsuit was filed on Nov. 16, 2011 following the termination of Mulligan's employment with the village.

"It is frustrating to see our resident's tax dollars spent in such a manner," Village President Benjamin Sells wrote in a news release. "Still, the Village Board has acted in the best interests of [Riverside] by taking this step to move forward and put this case behind us."

The Suburban Life previously reported Mulligan filed a wrongful termination lawsuit against the village and Fire Capt. Matthew Buckley, who Mulligan alleged mounted a campaign to oust him beginning in 2008 on the grounds that the chief was intoxicated several times while on duty.

According to the lawsuit, Mulligan was ordered to be evaluated through the village’s Employee Assistance Program for alcohol abuse on Dec. 30, 2008 and March 3, 2009. He was judged not to be alcohol dependent on both occasions.

Mulligan was ordered to submit to a leadership evaluation combined with a third alcohol evaluation and was again found to be free of alcohol dependence, according to the lawsuit.

Mulligan also claims in the lawsuit that former Village President Michael Gorman considered Mulligan to be disabled and set out to terminate him.

Mulligan was named chief in 2006.
