Naperville North teacher found guilty of making improper turn in fatal crash

BATAVIA – Kane County Circuit Court Judge Elizabeth Flood on Aug. 7 found an Oswego man guilty of not properly yielding in a two-car collision in February that killed a 61-year-old Sugar Grove man.

Flood sentenced Craig Schindlbeck of Oswego, a Naperville North school teacher, to six months court supervision. He also was fined $300.

She based her sentence on the fact that Schindlbeck does not have a history of traffic violations.

David Schele Sr., who owned and operated the Close Encounters Collision Center in North Aurora for 30 years, was killed in the crash.

A lawsuit was filed against Schindlbeck by Schele’s family.

“It seems like you were trying to be cautious,” Flood told Schindlbeck.

The Batavia Police Department on March 22 ticketed Schindlbeck for failure to yield while turning left.

He pleaded not guilty.

Schindlbeck testified that the light was green when he entered the intersection.

“I was in the center of the intersection, waiting for the traffic to clear,” he said. “The light was red when I made the turn. I never saw the [other] vehicle prior to the collision.”

Schindlbeck’s attorney, Frank Giampoli, did not want to comment after Flood’s ruling.

Schele’s family filed a suit in June against Schindlbeck. The suit seeks damages of more than $50,000.

The suit alleges that Schindlbeck failed to keep a proper lookout for Schele’s vehicle, failed to obey a traffic control device, failed to make a proper left-hand turn, failed to yield the right of way and was otherwise careless and negligent.

The suit states that as a result of Schele’s death, the plaintiff, David A. Schele Jr., sustained great losses in the form of medical, funeral and burial expenses.
